1. About us and these terms
comparethelend.com (the "Service") is operated by [CompareTheLend Ltd] ("CompareTheLend", "we", "us", "our"), a company registered in England and Wales under company number [company number], with its registered office at [registered office address].
These Terms of Use ("Terms") govern your access to and use of the Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. What CompareTheLend is — and is not
CompareTheLend is a comparison and introduction platform for UK business finance. We help businesses assess their funding position and compare and request indicative offers from the lenders on our panel.
We are an introducer and technology platform. We are not a lender, and we do not ourselves provide finance. Any finance is provided by a third-party lender under a separate agreement between you and that lender. We are not a party to that agreement.
The Service is provided to businesses. It is not intended for consumers acting outside their trade, business or profession.
3. Eligibility
To use the Service you must:
- be a UK-incorporated business (or an authorised representative of one);
- be at least 18 years old; and
- be authorised to act on behalf of the business, including to provide its information and bank statements.
By using the Service you confirm that you meet these requirements.
4. Your account
You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us promptly at [support@comparethelend.com] if you believe your account has been accessed without your authorisation. We may suspend or close accounts that breach these Terms or that we reasonably believe are being used improperly.
5. How the Service works
Through the Service you can provide information about your business, upload bank statements, receive an indicative assessment of your funding position, and request offers from lenders on our panel. When you request offers, you authorise us to share the relevant information with the lenders you select.
Lenders respond with their own indicative or firm offers. Any offer is made by the lender, on the lender's terms, and is subject to the lender's own checks, underwriting and final decision. Nothing on the Service obliges any lender to provide finance, or obliges you to accept any offer.
6. No advice, and no guarantee of finance
This section is important.
- The assessments, scores, "true cost" calculations and comparisons we present are indicative and for information only. They are estimates based on the information available and may differ from the actual terms a lender offers.
- The Service does not constitute financial, legal, tax, accounting or credit advice, and is not a personal recommendation. You should take your own professional advice before entering into any finance agreement.
- We do not guarantee that you will be offered finance, or finance on any particular terms. Lending decisions are made solely by the lenders.
- You are responsible for reviewing the full terms of any offer directly with the lender before you accept it.
7. Your responsibilities
You agree that the information you provide — including bank statements and declarations — is accurate, complete and not misleading, that you are authorised to provide it, and that you will keep your account details up to date. Providing false or misleading information may result in suspension of your account and may be reported where we are required or entitled to do so.
8. How we are paid, and broker relationships
We may receive a commission or fee from a lender when finance is arranged through the Service. This does not change the price the lender quotes you. We may also work with introducing brokers who refer businesses to us, and we may share a portion of our commission with them. The order in which lenders or offers appear on the Service may reflect commercial arrangements as well as suitability, and we indicate this on the platform. We always encourage you to compare the total cost of any offer.
9. Acceptable use
You agree not to misuse the Service, including by: attempting to gain unauthorised access; uploading unlawful, infringing or malicious content; using the Service to submit information you are not authorised to provide; interfering with its operation; or using it other than for its intended purpose of arranging business finance for a business you are authorised to represent.
10. Intellectual property
The Service, including its content, design, software, and the CompareTheLend name and branding, belongs to us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, reproduce, or create derivative works from the Service without our permission.
11. Third-party lenders and content
Lenders on our panel are independent third parties. Their products, offers and communications are governed by their own terms and privacy policies. We are not responsible for the acts, omissions, decisions or products of any lender, and any agreement you enter into is between you and that lender.
12. Availability
We aim to keep the Service available and accurate but do not guarantee that it will be uninterrupted, error-free, or that any indicative figure is exact. We may change, suspend or withdraw all or part of the Service, and may carry out maintenance, at any time.
13. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so (including for death or personal injury caused by our negligence, or for fraud).
Subject to that, and because the Service provides indicative information to help you make your own decisions:
- we are not liable for any decision you make to apply for, accept or decline finance, or for the terms, conduct or decisions of any lender;
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or anticipated savings; and
- our total liability to you arising out of or in connection with the Service and these Terms is limited to £100.
This reflects the fact that the Service is provided to businesses and that finance is provided by third-party lenders under separate agreements.
Reviewer note: the liability cap and exclusions above are commercial choices. Have your solicitor confirm they are appropriate and enforceable for your model.
14. Privacy
Our use of personal data is described in our Privacy Policy [link], which forms part of your use of the Service.
15. Termination
You may stop using the Service and ask us to close your account at any time. We may suspend or terminate your access if you breach these Terms or where we reasonably need to. Provisions that by their nature should survive termination (including Sections 6, 8, 10, 11 and 13) will continue to apply.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
17. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
